Terms and Conditions

 

General
1.1. These Conditions shall supersede all earlier conditions of Adrenaline Guru Ltd
1.2. These conditions shall take precedence over any conditions of the Customer and shall not be varied without the written consent of a director of Adrenaline Guru Ltd
Definitions
2.1. Adrenaline Guru Ltd, Suite 81, 792 Wilmslow Road, Didsbury Manchester M20 6UJ.
2.2. "Customer" means the person, firm or company buying or agreeing to buy goods and services from Adrenaline Guru Ltd.
2.3. "Price Paid" means the price paid by the Customer for the Product excluding carriage and any credit surcharge. The Price Paid is stated on the Order Confirmation.
2.4. "Order Confirmation" means the acknowledgement of the Customer’s order sent to the Customer by Adrenaline Guru Ltd
2.5. "Product" means any goods supplied to the Customer by Adrenaline Guru Ltd
Prices and Ordering
3.1 All prices shown are inclusive of VAT at 17.5% (where applicable). An Invoice will be sent with all orders that are VAT Rated
3.2. The price payable by the Customer will be the price current at the date of the order.
3.3. Reservation of Products does not constitute an order and is not binding on either party.
3.4. Orders are accepted by writing or Internet. Orders are only binding when Adrenaline Guru Ltd accepts payment in full for the order and the customer receives payment confirmation in writing.
3.5. Acceptance of your order and the completion of the contract between the customer and Adrenaline Guru Ltd will take place on despatch of the products ordered, unless we have notified you that we do not accept your order or you have cancelled it.
Payment
4.1. Payment is accepted via on-line credit or debit card payments via encrypted servers.
Delivery
5.1. Any delivery date stated is only a warranty by Adrenaline Guru Ltd to use reasonable endeavors to affect delivery by that date. No liability will be accepted by Adrenaline Guru Ltd for failure to meet a stated delivery date.
5.2. Products supplied by Adrenaline Guru Ltd are delivered at the risk of Adrenaline Guru Ltd. Customers must make a claim for damage or loss of the goods in writing:
if a Product is damaged, Contact Adrenaline Guru Ltd in writing within 48 hours of delivery (24 hours for off-road vehicles)
if a Product has been lost or is short, Contact Adrenaline Guru Ltd within 48 hours of delivery.
No claim for loss or damage will be allowed if the Customer claims outside the above time limit.
5.3 We are not responsible for any delays or errors in delivery caused by our carriers. 99% of our orders are dispatched the same or next day. No compensation will be given under any circumstances in reference to any late delivery. Extended delivery times apply to the Scottish Highlands, Islands, N. Ireland and the Channel Islands.
5.4 You must ensure the address and postcode entered during checkout is correct , further delivery costs will be incurred if the address supplied is in-correct and the delivery cannot be completed. Items returned to us as "un-deliverable" by our couriers will not be re-dispatched until extra postage costs have been paid in full.
5.5 It is the buyers responsibility to provide an address suitable for delivery where the item can be checked and signed for. A signature given at the address supplied by the buyer will be taken as proof of delivery.
5.6 All items must be checked on delivery before signing for the item. A signature is required as proof of delivery at the address supplied by the buyer , it is the buyers responsibility to arrange for receipt of any items purchased at the address supplied. Items cannot be left at the delivery address without a signature. Please do not ask for items to be left with neighbours or in outbuildings , all items must be signed for. If the item is damaged, please refuse the delivery and contact us immediately.
 
Consumer Rights
6.1. If you purchased the goods online and are a consumer (a private person buying for their personal use) then you may cancel your purchase at any time within 7 days of receipt and we will give you a refund of the price paid. This does not apply to the sale of off-road vehicles, where we will at our discretion replace faulty parts only. It is a pre-condition to our acceptance of these unwanted goods that they are returned in an unused condition, complete, unopened and in a re-saleable condition. It is your responsibility to pay for the carriage cost of returning the goods to us. In order to return the goods to us you must first contact us. The return will be authorized and you should then return the goods. It is your responsibility to ensure that the items reach us safely and in a satisfactory condition. We cannot accept any liability for goods that are damaged in transit and would recommend that you ensure that the goods are sufficiently packaged to prevent this from happening. If any items are returned in a used condition or have any components or parts missing or are incomplete as per the original order , Adrenaline Guru Ltd reserves the right to refuse a refund until the order is returned complete. We do not refund return postage costs , the buyer is responsible for all return carriage costs under all circumstances. A 20% re-stocking fee will be deducted for any returned items that are damaged in any way.
Uncontrollable Events and Delays
7.1. In case of delays caused by circumstances beyond the control of Adrenaline Guru Ltd or its suppliers, Adrenaline Guru Ltd shall have the right to either suspend delivery or to cancel the contract without liability.
7.2. Examples of Uncontrollable Events are (by way of example and not limited to) strike, lockout, riot, revolution, war, extreme weather ,epidemic, working difficulties, transportation difficulties, fire, and failure of suppliers or official regulations.
Customers Obligations
8.1. You are responsible for your own choice of Product and the suitability for any particular purpose. You must ensure that any Products are compatible.
8.2. You must provide reasonable courtesy information and co-operation to Adrenaline Guru Ltd
Title and Risk
9.1. Until full payment has been received by Adrenaline Guru Ltd for all Products whatsoever, supplied at any time by Adrenaline Guru Ltd to the Customer: -
9.1.1. Property of the Products shall remain in Adrenaline Guru Ltd.
9.1.2. The Customer shall store the Products in such a way that they are safe, and at all times in accordance with Manufactures recommendations;
The risk in the goods shall pass from the seller to the buyer upon delivery of such goods to the buyer. However, not withstanding delivery and the passing of risk in the goods, title and property in the goods, including full legal and beneficial ownership, shall not pass to the buyer until the seller has received in cash or cleared funds payment in full for all goods delivered to the buyer under this and all other contracts between the seller and the buyer for which payment of the full price of the goods there under has not been paid. Payment of the full price of the goods shall include the amount of any interest of other sum payable under the terms of this and all other contracts between the seller and the buyer under which the goods were delivered.
Marketing Emails
10.1 ‘Marketing Emails’ refers to any promotional email communication. The information transmitted in these emails is intended only for the person(s) or entity to which it is addressed and may contain proprietary, confidential and/or privileged material. If you have received an email in error, please contact the sender. Although the emails and any attachments are believed to be free of any virus, it is the responsibility of the recipient to ensure that they are virus free and no responsibility is accepted by the sender for any loss or damage arising in any way from the receipt or use thereof.
Miscellaneous
11.1. If any part of these Terms and Conditions are found to be invalid or unenforceable by a court the rest are unaffected.
11.2 Errors and omissions are accepted. Prices valid for the indicated time period only.
11.3 Adrenaline Guru Ltd shall not be responsible for any loss or damages, whether direct, indirect, incidental or consequential, arising from the use, misuse or abuse of a product or any accessory required to operate such a product.

Warranty for Radio Controlled / Remote Controlled Products
Because of the nature of our products they carry a limited Warranty of 7 days from the date of invoice. The products we sell are used and operated "remotely" and as such, the outcome or result of any use of our products is entirely dependant on the skill and knowledge of the person operating the model and the conditions in which the model is used. Our products are not toys and you are advised to seek the guidance of an experienced RC Modeller if you any have doubts as to your ability to control the model correctly. We accept no responsibility for crash damage. It is impossible to determine whether crash damage was the result of a radio system failure or user error. We accept no responsibility for crash damage occurring during the use of any radio controlled model. We accept no responsibility for improper assembly of our products.
Returns Policy
The following returns policy applies to ALL models purchased from Adrenaline Guru Ltd regardless of type.
Any model purchased from us that has been used cannot be returned if damaged. We accept no responsibility for crash damage. It is impossible to determine whether crash damage was the result of a radio system failure or user error. We accept no responsibility for crash damage occurring during the use of any radio controlled model. We accept no responsibility for improper assembly of our products. In all cases the model should first be assembled ready for use and FULLY TESTED for correct operation of all the control servos and motors. In the case of all radio controlled models , these checks are essential and should be carried out with the model secured on the ground before any flight/ride is attempted. In the case of cars, trucks or boats the model should be placed on a stand with the model secure and not in contact with the ground (or water), then carry out a full check for correct operation. A range check should be carried out with the radio controller supplied. It is a danger to yourself and members of the public if you do not test a model correctly before use. WE DO NOT REFUND , EXCHANGE or REPAIR MODELS UNDER WARRANTY THAT HAVE BEEN DAMAGED IN ANY WAY. Carry out the checks to ensure correct operation before ANY USE.
Please Note- If any products returned to us are found to be faulty due to accident, damage, neglect or misuse, the model will not be repaired or replaced unless the cost of repair is met in full. The model will be held until payment is made in full for any repairs carried out and the return carriage costs paid. If any adjustments or modifications have been made to our products , they will NOT be accepted. All Products Carry a Limited Warranty, Only Mechanical Faults Are Covered. Broken/Damaged Units Will Not Be Credited or Exchanged. This does not affect your statutory rights. We do not refund return postage costs , the buyer is responsible for all return carriage costs under all circumstances. A 20% re-stocking fee will be deducted for any returned items that are damaged in any way.

Off-Road Product Sales Indemnity Disclaimer
Liability:
By buying this item the purchaser acknowledges to be at least 18 years of age (minors to use only with adult supervision). Purchaser also acknowledges that motorised products are inherently dangerous and hazardous, and that use of the product involves the risk and danger of serious bodily injury.

Purchaser agrees to comply with all applicable laws governing the use of the product, and to observe all appropriate safety precautions, including the wearing of appropriate safety gear.Off road products should not be used on any public highway and are not suitable for any persons under the age of 16 years.

Purchaser fully accepts and assumes responsibility for all such risks, losses, costs and damages incurred as a result of the use of the product.Your purchase of the product shall constitute your release and indemnity in favor of Adrenaline Guru Ltd, its directors from and against any and all claims or injuries of every kind resulting from use or operation of the product.

Please note:-

No warranty on Off-road products
If your product is damaged during delivery, Adrenaline Guru Ltd will at its option, repair or replace it free of charge if notified within 24 hours of delivery to you.

For a period of 7 days after your delivery, Adrenaline Guru ltd will at its option repair or replace any parts found to be defective in either material or workmanship.This shall not include damage from mis-use or damage that is not the result of normal use.This does not include normal wear to expendable parts.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NO OTHER WARRANTY EXPRESSED OR IMPLIED APPLIES TO THIS PRODUCT.
 
Fraud
Adrenaline Guru Ltd will pursue any/all individuals or companies that attempt to defraud us or any of our associated trading partners to the fullest extent that the law will allow , including recovery of any loss or debt via private prosecution and/or private debt collection.
